§ 13-48. Growth to certain height prohibited; offenses.

  • (a)

    A person commits an offense if he is an owner in the city and:

    (1)

    Permits weeds or grass or ground cover located on the premises to grow to a height greater than twelve (12) inches; or

    (2)

    Fails to remove prohibited weeds or prohibited grass or prohibited ground cover from the premises after they have been cut.

    (b)

    No plant life of any type (hedge, tree, bush, shrub or ornamental grasses) shall be planted or maintained in such a position or place so as to be dangerous or detrimental to the safety of persons in a way which obstructs the view so as to constitute a traffic hazard.

    (c)

    Allegation and evidence of a culpable mental state is not required for the proof of an offense defined by this section.
